Question: I did not file income tax return for the past 10 years?

I am an USA citizen (California resident). I moved to Taiwan 10 years ago to teach English. In the past 10 years, I file tax return in Taiwan, but I thought I don’t need to file tax return in USA and California. I earn approx. US$30,000 every year. Now I am applying green card for my wife. The embassy here ask me to file tax return for year 2005. My questions are:

1. Do I need to file income tax return (Fed and CA) for the past 10 years now?

2. Would I be penalized for not filing in the past?
3. Is private tutor income qualified for foreign earned income credit? If my students did not give me invoice, what kind of supporting document is needed?

Answer: I’d strongly suggest that you consult with a CPA or tax attorney. Among other things, you must file a timely return to claim the foreign earned income exclusion. You may well be penalized for late filing and payment of any taxes due. Those tax years are all still open and need to be closed. As I said, you need professional help and you need it quickly.

Question: Unsecured Property Tax in California??? Is this legal?

I have a small business. I recently received a tax statement assessed by my county for “unsecured property tax”, which includes tax on just about anything I use for my business. When I read this I could just not believe it. Is this legal? How can they tax me on my property, like my desk, or my car that I use for personal use and work? Isn’t it enough that I paid taxes on all that stuff when I BOUGHT it, and the fact that I pay income taxes as well? Where do they get this stuff????
I guess what I wanted to know is- How far have we gotten away from the constitution of the United States here? I mean, when the government can tax me on a desk not only when I buy it but for years after I buy it, isn’t that really kinda wrong? Next thing you know, they’ll be taxing me every time I fart…a “Fart Tax”. I mean, get real! Taxing me on “stuff” that I own, just because I have it? Cummon!

Answer: It’s a Personal Property Tax. At least in CA it’s only levied on businesses. Move to MO and see what they do here. Cars, boats, trailers, campers, airplanes, cattle, hogs, sheep, farm machinery, tractors, brush hogs, etc., yadda yadda are all subject to personal property taxes here.

FYI, The Constitution explicitly grants the right to levy taxes to the government. Virtually every state constitution grants the state government the same right in one form or another. If you don’t like your state’s taxes, contact your elected representatives or move to a more tax-friendly state for your situation.

Question: Do I need file 1040 or/and state tax for a no-income business?

I set up a corporate June 2007 in california. However, it never worked out. I closed it out in March 2008. I have an EIN# for it, but there is no assets, no inventory, no sales, no employee but only less than $100 state filing fees expenses. (Basically, it is a blank corporation) I couldn’t find any information at irs.gov to see if I need to file tax return for it. Can anybody help we with that?
If so, how do I file it? Can I do it myself? Is there any information on government website?

Answer: You were supposed to file the corporate return by 3/15. You now owe at least 1 $85 penalty for failure to file.

You also owe $800 to the CA.
