Question: Father abandons Wife&Daughter for 2 years! What legal right does she have to keep him from taking daughter?

Here is the story, factual and true. German woman, not a US citizen(Germany does not allow dual citizenships) has been living and working, paying taxes, owns home, etc for the last 18 years. Ex-husband, Nigerian born , became US citizen. They marry, have a beautiful daughter. After several business failures and taking them to near bankruptcy, he abandons the family. WITHOUT notice, he moves back to Nigeria. He has now been gone 2 years this May/2008. Has asked about child in emails and Instant messages on Yahoo. Has provided no child support, no insurance, no shelter and the child has no clue who he is. She was 2 years old when he decided to leave the family. Yesterday 2/11/2008, he tells his ex-wife now, that he will be coming back to the United States in less than 2 weeks to get his daughter and that he has just as much right to do so as any other father. Is this for real? How can a person, leave their family, burden them with their bills then think he has rights? Help!!!

Answer: She needs to get the courts involved immediately. If he takes the child to another country she could be in for a really expensive and long custody fight.

With no court order for custody, it is possible for him to take the child out of country.

She needs to file for custody and protection. This may qualify for an emergency hearing for custody. If she can afford a lawyer, she should get one.
